Mercer is seeking a Senior Health & Benefits Consulting Attorney to join their team in the Central zone, working in a hybrid model. This role involves analyzing health and welfare benefit plan legislation, regulations, and judicial decisions to provide compliance guidance to clients. Key responsibilities include developing market-differentiating advice, drafting legal documents, acting as a legal/technical expert, consulting on plan design, and delivering presentations on health and welfare plan law topics.

  • Act as legal/technical expert providing compliance consulting, insights and solutions to clients and consultants.
  • Consult with clients on health and welfare plan design and cafeteria plan qualifications under the Internal Revenue Code and ERISA.
  • Present compliance consulting capabilities in business development settings.
  • Deliver presentations on a variety of health and welfare plan law topics.
  • Work collaboratively with consulting attorney colleagues and other experts to develop in-depth analyses.
  • Work successfully with Subject Matter Experts to help identify and address complex legal and compliance issues.
  • Proactively stay current on key federal and state health and welfare plan legislative and regulatory developments.
  • Juris Doctor Degree plus at least ten (10) years of experience in a Legal, Compliance, Legal Consultant, or a related position.
  • Ten (10) years of legal experience with employee benefits or tax, ACA, HIPAA privacy/security, COBRA, Mental Health Parity, state insurance laws, HR practice, and advising on employee benefit topics.
  • Must hold a current license or certificate to practice law from at least one (1) state bar association.
  • Excellent verbal and written communication skills.

We are seeking a talented individual to join our Health and Benefits Attorney team at Mercer. This role will be based in any Mercer office in our Central zone. This is a hybrid role that has a requirement of working at least three days a week in the office.

The Senior Health & Benefits Consulting Attorney will join a highly-skilled, cohesive team of lawyers and technical experts who analyze health and welfare benefit plan legislation, regulations, subregulatory guidance, and judicial decisions and provide guidance and practical next steps for compliance or mitigation to our clients.

We will count on you to:

  • Develop market-differentiating advice, insights, and solutions related to health and welfare plan compliance.
  • Analyze key policy, legislative and legal developments and issues, and share advice, insights and solutions with internal and external clients.
  • Draft legal documents including plan documents, summary plan descriptions, and compliance notices and disclosures for plan participants and beneficiaries.
  • Act as legal/technical expert providing compliance consulting, insights and solutions to clients and consultants on unique legal/technical and compliance issues affecting the design, administration, and operations of health and welfare plans programs, and practices.
  • Consult with clients on health and welfare plan design and cafeteria plan qualifications under the Internal Revenue Code and ERISA.
  • Present compliance consulting capabilities in business development settings to clients and prospective clients along with sales consultants, account managers, and business consultants.
  • Deliver presentations on a variety of health and welfare plan law topics, as needed, to clients, prospects and HR/benefits professionals in a variety of settings, including meetings, conferences and other forums.
  • Work collaboratively with your consulting attorney colleagues other experts to develop market-differentiating, in-depth analyses of, and insightful, practical implications relating to, key developments and topics in the health and welfare plan legal/regulatory space.
  • Work successfully with Subject Matter Experts to help identify and address complex legal and compliance issues, particularly those for which clear answers don’t exist.
  • Proactively stay current on key federal and state health and welfare plan legislative and regulatory developments

What you need to have:

  • Juris Doctor Degree plus at least ten (10) years of experience in a Legal, Compliance, Legal Consultant, or a related position.
  • Must have ten (10) years of legal experience with: Employee benefits or tax; ACA requirements; HIPAA privacy and security consulting for group health plans; COBRA continuation coverage; Mental Health Parity; State insurance laws and regulations; HR practice, laws, plans, and operations; Advising on employee benefit topics with a service provider firm, consulting firm, law firm, or government agency.
  • Must hold a current license or certificate to practice law from at least one (1) state bar association.
  • Excellent verbal and written communication skills, particularly the ability to communicate technically complex developments, issues, and analyses in easy-to-understand and actionable ways

The applicable base salary range for this role is $176,400 to $352,800.

The base pay offered will be determined on factors such as experience, skills, training, location, certifications, education, and any applicable minimum wage requirements. Decisions will be determined on a case-by-case basis. In addition to the base salary, this position may be eligible for performance-based incentives.
