Job Description

As Senior Employment Counsel, you'll provide day-to-day legal advice and counsel on labor and employment matters, including employee data privacy. Responsibilities include drafting and reviewing employment contracts and policies, conducting investigations, managing litigation, and representing the company in mediations. You'll work closely with internal stakeholders to ensure compliance with Philippine and US labor laws. Experience in handling administrative investigations and managing litigation is crucial. The role involves supporting the global People team with labor and employment advice for the Philippines and assisting the North America Legal team as needed.
Must have:
  • 5-7 years relevant legal experience
  • Philippine labor & employment law expertise
  • JD/LL.B degree & Philippine Bar license
  • Contract drafting & review experience
  • Proficiency in Philippine labor laws
  • Excellent communication & negotiation skills
  • Strong analytical & problem-solving abilities

Our legal team is responsible for managing risk across the business while bringing our product and operations to life in a way that is consistent with our mission. We partner with Finance, Engineering, Product, Marketing, Sales, the People team, Operations and more to craft a marketplace that delivers business to our pros while helping millions of customers get their projects done each year. About the Role

As a Senior Employment Counsel, you will support the Company and partner across the Legal Function, with a personal emphasis on labor & employment, and other general issues that the Company encounters. Thumbtack attorneys work on a variety of engaging and challenging legal issues each day and the key to this role’s success will be to earn the trust of our business colleagues and provide expeditious, practical legal advice that helps identify and then mitigate risk across. 

Your Responsibilities

  • Provide day-to-day advisory support on labor and employment (including employee data privacy) advice and counsel, working closely with internal stakeholders to develop frameworks that ensure compliance with relevant laws and regulations.
  • Formulate and review employment-related contracts and policies to align with legal requirements and company standards.
  • Prepare standard documentation and filings for various stages of the employment life cycle.
  • Assist in conducting administrative investigations and review notices issued in connection with such investigations.
  • Represent the company at initial mediation conferences before the Department of Labor and Employment.
  • Manage litigation matters, coordinating with outside counsel for court appearances and required submissions.
  • Support our global People team with labor and employment advice for the Philippines, and assist the North America Legal team as needed.

To Be Successful, You Must Bring

  • At least 5-7 years of relevant legal experience, with a strong background in Philippine labor and employment law and employee data privacy compliance. 
  • Juris Doctor (JD) or Bachelor of Laws (LL.B.) degree holder.
  • Licensed to practice law in the Philippines with good standing at the Integrated Bar of the Philippines, with up-to-date Mandatory Continuing Legal Education credits.
  • Proven experience in drafting and reviewing employment-related contracts and policies.
  • Proficiency in Philippine labor laws and regulations, including the Labor Code of the Philippines, Data Privacy Act, and other relevant legislation.
  • Excellent communication and negotiation skills, with the ability to provide sound legal advice to stakeholders at all levels.
  • Strong analytical and problem-solving abilities, with a proactive approach to risk management and compliance.
  • Background in handling administrative investigations (including Committee on Decorum and Investigation or “CODI”) and managing litigation, including coordination with outside counsel.
  • Ideally, someone who can start immediately.

Bonus points if you have

  • Experience working in a US-based tech-driven environment, with exposure to complex employment and data privacy issues.
  • Notarial commission in Makati City
  • Familiarity with US employment laws and regulations.
  • Proficiency in using legal tech tools such as those related to contract management and legal research.
